General terms and conditions

I. Applicability

  1. These terms and conditions apply for contracts concerning the rental of hotel rooms of the hotel and for all services of the hotel.
  2. The customer’s terms of service are only applicable if this has been agreed upon expressively and in writing.

II. Vertragsabschluss und Vertragsinhalt

  1. Offers made by the hotel are subject to change. Contracts become valid by the agreement to a contract by the hotel. A confirmation about the contract in writing by the hotel is not mandatory.
  2. Neither subletting and re-letting of rented hotel rooms, grounds or facilities, nor their use for commercial purposes like sales or job-interviews are allowed, unless with express prior agreement of the hotel in writing.
  3. Customers are not entitled to any specific room for their accommodation. Unless arranged otherwise, customers are to move into their rented rooms on the day of their arrival not before 3 o’clock P.M. and not after 10 o’clock P.M (this period is called check-in). Customers are not entitled to any rooms being made available to them before or after that time. On the appointed date of departure, customers are to vacate their rooms before or at 12 o’clock A.M. (this period is called ‘check-out’). A delay beyond this point in time establishes a breach of contract and entitles the hotel to fully charge the customer the room-rate for another day (according to list-price). This does not entail any re-newed entitlement to service according to contract for the customer; he or she is free to prove that the hotel suffered no or smaller losses than the list-price.
  4. The use of hotel facilities (breakfast room etc.) is possible only within the respective opening times as published in a placard at a central point like the reception or the elevator. All such opening times are subject to change, facilities might be closed partially or completely for occasions like construction works, special events, or other circumstances which prevent in part or completely proper usage.

III. Prices, payment

  1. Customers are obliged to pay their accommodation and other services rendered by the hotel at the price which has been set previous by a table of prices or special agreement. This expressly includes services for third parties by the hotel if these have been initiated by the customer.
  2. All prices include the respective value-added tax as set by applicable law if not expressly agreed otherwise. If the interval between contract and fulfillment of contract is longer than four months any changes of list-prices or value-added tax can be added to the agreed price up to a limit of 10% of the originally agreed price.
  3. The currency for all billing is the Euro. Any currency fluctuations and bank service charges are the customer’s liability.
  4. Bills of the hotel are due for payment within 10 days after receiving in full. After 21 days without payment, the hotel can demand a default interest of 10% per annum. Customers are free to prove that the hotel suffered no or smaller losses, the hotel is free to prove higher losses.
  5. At any time the hotel might charge an apt prepayment. If not expressly agreed otherwise following prepayments apply:
    Accommodation and breakfast
    1. outside of trade-fair seasons a deposit of up to 50% upon contract
    2. during trade-fair seasons and with traveling parties a deposit of up to 100% upon contract
  6. All belongings in a customer’s may be subject to lien on moveable objects in case of a failure on the customer’s side to comply with demands on outstanding payments.
  7. Any complaints regarding a bill must be brought forth upon reckoning immediately.
  8. The desired form of the bill (recipient on invoice) must be declared by customers upon booking or, at the latest, upon end of the end of the accommadation.

IV. Hotel’s withdrawal from contract

  1. If a prepayment according to a contract isn’t made within a reasonable period of time, as declared by the hotel, the hotel can withdraw from that contract.
  2. Furthermore, the hotel can withdraw out of justifiable substantial reasons, if for example
    1. higher powers or other circumstances, which the hotel does not have influence on, prevent the hotel from fulfilling the contract
    2. accommodations or services have been booked upon giving false or misleading information, for example on the customer’s identity or intentions
    3. there is a founded belief that an accommodation would endanger the orderly performance of day-to-day business, security or reputation of the hotel without any blame to the hotel’s management or
    4. there is a violation against paragraph II..
  3. The hotel must inform customers about their right to withdraw from the contract immediately.
  4. In case of a justifiable withdrawal from the contract by the hotel customers are not entitled to any reimbursement.

V. Cancellation by customer

  1. Cancellations must be handed in writing.
  2. Outside trade-fair seasons following conditions for cancellations by customers are applicable:
    The hotel warrants a cancellation free of charge up to two days prior to the customers’ arrival. In cases of a delayed cancellation or a customer not arriving we reserve the right to charge for our losses due to the room(s) not being rented.
  3. During fair-trade seasons:
    The hotel warrants a cancellation free of charge up to 90 days prior to the customers’ arrival if no different arrangements have been made, After this point in time the booking is a mutually binding contract and in cases of a delayed cancellation or a customer not arriving we reserve the right to charge for our losses due to the room(s) not being rented.
  4. Special conditions for cancellation:
    Following trade-fairs require a cancellation be made 120-day prior to arrival: MEDICA , DRUPA, INTERPACK, K–MESSE(KUNSTSTOFF), METEC, METAV-TUBE- WIRE, GLASTEC, IBA. In case of a delayed cancellation, failure to arrive (no-show) or shortening of stay the hotel will charge 100% of the room-price for the booked complete length of the stay.
